By using this website, contacting Legacia or engaging any of its services, you confirm that you have read and accept these Terms and Conditions.

You must be at least 18 years of age and have the legal capacity to enter into a contract under Malaysian law to engage Legacia's services.

Where a service is engaged on behalf of a group of family members, the individual who signs or approves the Scope Confirmation accepts these terms on behalf of all parties involved in the engagement.

3. Description of services

Legacia provides document recording, inventory, cataloguing and administrative support services for families managing estate records. The specific scope of each engagement is set out in a written Scope Confirmation sent before work begins.

Legacia's services are clerical and organisational in nature. Legacia is not a licensed legal practitioner, licensed valuer, financial adviser or any other type of regulated professional. Nothing in the work Legacia produces constitutes legal advice, financial advice, a valuation or any form of professional opinion on the content, ownership or value of any item or document recorded.

Services are available to clients based in Malaysia. International engagements may be considered on a case-by-case basis.

5. Intellectual property

The written catalogues, indices and summaries produced by Legacia as outputs of its services are provided to you for your own personal, family and professional use. You may share them with solicitors, accountants, trustees and other professionals involved in the estate.

Legacia retains copyright in the format, layout and reference coding system used in its written outputs. You may not reproduce or resell those outputs as a product or service of your own.

The content of this website — text, layout and design — is the intellectual property of Legacia. It may not be reproduced without written permission.

Legacia's services are provided as described in the Scope Confirmation. Legacia does not warrant that its written outputs will be accepted as evidence by any court, registry or professional body, or that they will meet any specific purpose the client has not communicated to Legacia in advance.

Legacia does not assign values, make recommendations about distribution, or offer advice on legal, financial or tax matters. Clients should obtain independent professional advice for those matters.

This website and its content are provided for information purposes only. Nothing on this website constitutes professional advice of any kind.

9. Limitation of liability

Legacia's liability for any claim arising from a service engagement is limited to the fee paid for the specific engagement to which the claim relates.

Legacia is not liable for indirect, consequential or incidental losses, including any losses arising from decisions made by the client or third parties on the basis of Legacia's written outputs.

Nothing in these terms limits Legacia's liability for death or personal injury caused by its negligence, or for fraud or fraudulent misrepresentation.

10. Indemnification

You agree to indemnify Legacia against any claims, losses or costs arising from your misuse of Legacia's written outputs, your provision of inaccurate information that affects the service, or your breach of these Terms and Conditions.

11. Termination

Either party may terminate a service engagement by giving written notice. Fees for work completed to the point of termination are payable by the client.

Legacia may suspend or terminate an engagement if the client provides materially inaccurate information, withholds access necessary for the work, or asks Legacia to act outside its stated scope.

On termination, Legacia will return any physical documents held and delete digital copies within 30 days.

12. Governing law and disputes

These Terms and Conditions are governed by the laws of Malaysia. Any dispute arising from or in connection with these terms or any service engagement will be subject to the exclusive jurisdiction of the courts of Malaysia.

Before commencing formal proceedings, both parties agree to attempt to resolve disputes informally by written communication. If resolution is not reached within 30 days, either party may proceed to formal dispute resolution.

Legacia may update these Terms and Conditions from time to time. The current version will always be available on this website. For active service engagements, any material changes will be communicated by email before they take effect.
